Article 1 – Applicability

These terms and conditions apply to all agreements with Bliz Events BV, having its registered office in Bussum, related to the participation in trainings, lectures, workshops, seminars, congresses and conferences, hereinafter referred to as ‘events’. Deviations from these terms and conditions are only binding if and insofar they are confirmed by Bliz Events in writing. ‘Participant’ is the party who registered for an event organised by Bliz Events.

Article 2 – Booking

The possibility exists to book up to a maximum of four weeks prior to commencement of the event. The following needs to be indicated in an email to office@blizevents.com, if not booked through the website of Bliz Events: A) the event in question, B) how many tickets should be reserved, and C) the complete contact information of each individual participant. Bliz Events confirms the booking and keeps the ticket(s) available up to the expiration date of the invoice. The booking expires after two weeks and the participant can no longer claim the booked places but is still liable to pay for the reservation.

Article 3 – Conclusion of the agreement

The agreement between Bliz Events and the participant is concluded either by filling in the booking information on the website by the participant or by filling in a special registration form by the participant. It is also concluded where Bliz Events acts as the organizer for and on behalf of third parties.

Article 4 – Cancellation by the participant

Daily period programme (programme that does not last longer than one daily period): In case of cancellation up to 4 weeks prior to commencement of a daily period programme the participant is held to pay 15% of the complete participation amount (with a minimum of EUR 15.00 per participant) on account of administration and cancellation costs. In case of cancellation within 4 weeks prior to commencement of a daily period programme the participant is held to pay the complete participation amount. Programmes that last longer than one daily period: In case of cancellation longer than 90 days prior to commencement of a programme the participant is held to pay a cancellation/administration fee of 30 euro. In case of cancellation up to 90 days prior to commencement of a programme the participant is held to pay 30% of the complete participation amount. In case of cancellation within 60 days prior to commencement of the programme the cancellation costs amount to 50% of the participation amount. In case of cancellation within 30 days prior to commencement of this programme the participant is held to pay the complete participation amount. Cancellation of all programmes needs to take place in writing. The participant may at all times have somebody else participate in the relevant event in his/her place or yet participate in the same event within a year following registration (if still offered by Bliz Events). For the assessment of the cancellation period either the date on which the email is received by Bliz Events or the postmark is assumed.

Article 5 – Cancellation and/or change by Bliz Events

Bliz Events is entitled to, without statement of reasons, cancel an event in which case the participant is entitled to restitution of the complete amount paid to Bliz Events. If possible Bliz Events will offer a suitable alternative. If the participant makes use of the alternative, restitution will not take place. Bliz Events is at all times entitled to change the date, the time, the hours and the location of an event. If Bliz Events reaches the decision that it can in fairness not be expected of the participant to attend the event under the changed circumstances, Bliz Events may decide to (partial) restitution or not of the ticket price. Bliz Events is at all times free to change the content and the organization of the event, without entitling the participant to any compensation for damages. In very exceptional cases it occurs that the scheduled speaker/trainer cannot personally tend to the event. The participant agrees that in that case Bliz Events will deploy a substitute speaker/trainer which will in fairness not affect the quality of the event. In this case the participant will neither be entitled to cancellation of the event nor to restitution of the participation costs. Bliz Events will forthwith inform the participant of any of the aforementioned changes.

Article 6 – Change of participation

The participant is entitled to change his/her participation to the same yet later scheduled event if available free of charge, as set forth in article 5, up to 3 weeks prior to commencement of the event without additional costs on the part of the participant. In case of a change within 1 week prior to commencement of the event EUR 25.00 is charged to the participant on account of administration costs.

Article 7 – Privacy

All personal information obtained within the framework of the agreement with the participant is handled strictly confidentially and in accordance with the applicable privacy legislation. If Bliz Events is in charge of the organization of an event for or on behalf of a third party, the participant's (contact) information may be shared with this third party.

Article 8 – Exclusion

Bliz Events is entitled to, without statement of the reasons, exclude a participant from participation prior to commencement of an event in which case the participant is entitled to restitution of the complete amount paid to Bliz Events by the participant. Bliz Events reserves the right to deny access to an event to a participant who arrives more than 1 hour late and in case this would, at the discretion of Bliz Events, have a disturbing effect on the meeting in which case the participant is not entitled to any restitution. Bliz Events reserves the right to remove a misbehaving participant from an event in case the misbehaviour, at the discretion of Bliz Events, has a disturbing effect on the activities in which case the participant is not entitled to any restitution.

Article 9 – Replacement

In case of the inability to attend the participant may have his/her place taken by a person of his/her choice if the complete name and contact information of the this person are communicated to Bliz Events by email at least two days prior to commencement of the event. This service does not affect the right of Bliz Events to refuse a participant or to cancel an event.

Article 10 – Fees

Fees are mentioned in the newsletters, advertisements and folders from time to time published by Bliz Events as well as on the website (printing errors reserved). These fees are binding unless a different fee is stipulated in a written agreement. Bliz Events is at all times entitled to change its fees, with the understanding that following confirmation of an event the at the time applicable fee shall remain valid unless the event is cancelled and moved to a later date in which instance the fee at the time of the new confirmation shall apply. Fees mentioned are in Euros and including applicable VAT, unless stated otherwise.

Article 11 – Payment

The participant is held to pay invoices within 14 days following the date of the invoice, or at the latest 5 working days prior to commencement of the event - whichever date comes first, to our Rabobank account 12.95.95.292 in the name of Bliz Events in Bussum, in case payment did not already take place by means of iDeal or creditcard on the website. With regards to early booking rates, the fee should be received in the Bliz Events bank account before the early booking fee expires. If received later than this date, Bliz Events is entitled to claim the regular fee. The following information should be mentioned with your bank wire:

• invoice number;
• name event;
• your address (not all banks mention this).

For participants who remit money from abroad: BIC: RABONL2U; IBAN: NL95 RABO 0129 5952 92.

In case of untimely payment the participant is automatically in default without any notice of default by Bliz Events being required and a late payment interest of one percent (1%) will be payable per calendar month or part thereof. All costs that Bliz Events should, in fairness, incur in connection with shortcomings attributable to the participant in the fulfilment of his/her obligations with Bliz Events are at the expense of the participant. This is understood to comprise costs related to internal administrative processing and all (extra) judicial (collection) costs in connection with external (legal) assistance that will amount to a minimum of fifteen percent (15%) of the payable amount with a minimum of EUR 136.00 per invoice. Only upon receipt of the complete payment by Bliz Events the registration is definite.

Article 12 – Intellectual property

The copyrights, database rights, brand rights, patent rights and all other intellectual property rights with regard to the event and with regard to all folders and digital information published by or on behalf of Bliz Events in connection therewith are exclusively vested in Bliz Events and/or its licensor(s). All intellectual property rights, such to include however not limited to the copyrights, with regard to reports, proposals and other documents originating from activities of Bliz Events or its representatives are exclusively vested in Bliz Events and/or its licensor(s). All information and (work) material acquired from or on behalf of Bliz Events within the framework of the event are exclusively meant for the personal use by the participant or his/her organisation. The participant is not allowed to, either wholly or partly, duplicate or disclose, in any way whatsoever, the acquired information/material outside of this scope without prejudice to the prior approval of Bliz Events in writing. The agreement with the participant neither, in no way whatsoever, extends to the transfer of any intellectual property right with regards to the event and to the information offered by or on behalf of Bliz Events within the framework thereof nor to any licence right, unless explicitly determined otherwise.

Article 13 – Liability

Bliz Events commits to organize the events to the best of its abilities and insight. In case the event is taken care of by a third party on behalf of Bliz Events, Bliz Events only accepts liability for this third party in case of an act or omission of this third party during the event itself, without prejudice to the provisions set forth in this article with regard to the limitation of the liability of Bliz Events. Bliz Events does not accept liability for damages resulting from any act or omission on the basis of the acquired information, unless these damages can be attributed to intent or gross negligence on the part of Bliz Events. Per occurrence the possible liability is at all times limited to at most the amount paid to Bliz Events by the participant in connection with the event , whereby a series of occurrences is held to be one occurrence. In no instance whatsoever is Bliz Events liable for indirect and/or consequential damages such as, for example, lost income. Bliz Events neither provides guarantees nor makes any promises with regard to results to be accomplished due to participation in an event organised by Bliz Events. The participant participates in the event at his/her own responsibility.

Article 14 – Confidentiality

Bliz Events shall, with regard to the use of information provided or taken note of in connection with the event, abide by such accurateness as may in fairness be expected of the same.

Article 15 – Complaint procedure

Bliz Events tries to the best of its abilities to guarantee the quality of its events. Should the participant nonetheless have any comments with regard to the quality he/she can send these in writing to Bliz Events BV, Liesbeth Bakker, P.O. Box 1363 1400 BJ Bussum, The Netherlands.

Article 16 – Applicable law and competent Court

Dutch law exclusively applies to the legal relation between Bliz Events and the participant. Disputes deriving from agreements to which these terms and conditions apply are exclusively brought before the competent Court in Amsterdam.
